Has A Skilled Nursing Facility Provided Inadequate Care?

According to a study conducted by Medicare’s Inspector General, the rate of medical errors resulting in injuries and death in skilled nursing facilities was much higher than that reported for hospitals. Skilled nursing facilities, which include certified nursing homes, typically provide follow-up treatment for patients after they have been discharged from acute care at a hospital, but medical errors at these establishments are not as widely reported as those that take place at hospitals. Errors that occurred during patient treatment at these facilities – including everything from dispensation of the wrong medications to infections – resulted in damages both temporary and permanent, and more than half of the patients who were harmed had to be hospitalized at additional expense. The study also revealed that a majority of these errors were actually preventable. If you or a loved one has been victimized by nursing home errors, please be aware that you have legal recourses available. Are Your Children Properly Prepared For Road Safety In This New School Year?

Thousands of school children across South Florida head back to school in mid-August. As students get back to their daily travel routines, it’s important for all parents to take a little extra time to ensure their children’s safety. This becomes a peak time for accidents and injuries while walking, biking or riding to school. Most drivers have been used to a lack of children on the streets during the summer and may fail to realize that now there will be many more children on the road, due to the start of a new school year. 1. If your children walk to school, make sure they understand that they must walk on the sidewalk, and must walk facing traffic. If they cross streets on their way to and from school, instruct them to carefully look for cars coming in either direction. Also, impress upon them that they must walk especially carefully around parked cars. 2. If your children ride bicycles to school, make sure that they wear helmets. Review all the basic bicycling safety rules with your children, including hand signals, riding at safe speeds, riding…Read More

Using Cell Phones While Driving Increases Probability Of Accidents

Study conducted by researchers at the University of Alberta, Canada, found that motorists who talk on cell phones while driving made more driving errors compared to drivers who were not engaged in phone conversations. The study revealed that these motorists were found to be much more likely to make common driving errors, including improper lane changes, driving at excessive speeds and suddenly crossing center lines. The researchers found that, even if a person is using a hands-free cell phone, there’s still an increase in brain activity and an increase in heart rate. Even if the conversation was not emotional in nature, the study revealed that there were definitely changes in the person’s emotional reaction to the conversation, resulting in an increase in the number of driving errors made – almost all of the participants in the test groups made some sort of driving error as a result of phone usage. If you have been involved in an automobile accident as a result of someone else’s negligence, you may be entitled to money damages. Happy Birthday America

Reflections On The 4th Of July As we celebrate the 242nd Anniversary of our Declaration of Independence, I am reflecting on how proud I am to be both an American and a Lawyer. While we all laugh at the many jokes constantly directed at the legal profession (and some of them are funny), it is important on every 4th of July to remember that many of our country’s forefathers were lawyers. Indeed, of the initial ten Amendments to the United States Constitution, four (Amendments 5-8) deal directly with legal rights. Four of the five members of our first Continental Congress entrusted with developing the Declaration of Independence were lawyers – Roger Sherman, John Adams, Robert Livingston and Thomas Jefferson. Two of them, Adams and Jefferson, went on to become Presidents of our county. And James Madison, the “Father of the Constitution” and the “Bill or Rights” (and our fourth president as well) was also a lawyer. In fact, 25 of the nation’s 45 Presidents have been lawyers. So I am indeed honored to practice this great profession, and to have the ability to fight for…Read More

Do You Really Need Legal Help For A “Minor” Auto Accident?

While minor “fender benders” in South Florida often result in negligible property damages, it is never safe to assume that such simple accidents always result in logical outcomes. Vehicle occupants, for instance, could have suffered injuries that were not immediately apparent at the time of the collision. And since insurance company adjusters are not necessarily agreeable with these premises – often offering inadequate compensation to individuals involved in car crashes dealing with lesser property damage – it is highly recommended that, if you’ve been involved in any kind of auto accident you take two immediate important steps: First, visit a doctor as soon as possible, as a trained physician can detect physical damage that may not be immediately apparent. And second, secure the assistance of an experienced auto accident and personal injury attorney. It is the job of the Fenstersheib Law Group, P.A. to fight for your rights and ensure proper compensation for your pain and suffering. Should you or a loved one have unfortunately been injured in an auto accident in South Florida, it is vital that you contact our Injury Legal Team immediately so that…Read More

What Is The Meaning Of Contingency Fees?

Personal injury lawyers typically work on a contingency fee basis. This means that compensation for their legal services gets recovered only after they have managed to obtain a favorable settlement or verdict for their client. Normally, contingency fee plans are based on a percentage of the money that has been recovered in the case, and since the attorney gets paid only in the event of a favorable outcome, these plans are extremely beneficial for victims of personal injuries, as all legal expenses to file the case are borne by the attorney. The Florida Supreme Court establishes the percentages for contingency fees in our State, and these fees typically range between 33-1/3 and 40% (whether pre-suit or litigation) of the total compensation that has been awarded to the client. It is very important to note that a reputable personal injury attorney will always explain, fully and clearly – before he takes on a case – his specific contingency fee percentage to the client, and whether the fee is based on the net or gross amount of the compensation. If you or a loved one have suffered any…Read More

Blood alcohol level of 0.08% or more is the qualifier for drunk driving. Much smaller levels can still put people at an increased risk of accidents. Alcohol is a substance that reduces the function of the brain, impairing thinking, reasoning and muscle coordination. One-third of all traffic crash fatalities in the United States involve drunk driving and one person is killed every 51 minutes by a drunk driver on our Nation’s roadways. Remember that it is never okay to drink and drive, even if you’ve had one alcoholic beverage. Have a designated driver, call a taxi, a rideshare provider or plan to use public transportation to get home safely. DUI can set you back thousands of dollars in attorney fees, fines, court costs, lost time at work, higher insurance rates, repairs, and more. So do yourself – and those around you – a major favor: if you drink, don’t drive. It’s that simple. And if you, unfortunately, have suffered injuries in a vehicular accident due to the negligence of others, contact the Fenstersheib Law Group, P.A., toll-free, at 1-800-TellRobert. Can You File A Claim For Injuries In Florida If You Did Not Report Them At The Time Of The Automobile Accident?

If you find yourself involved in a car crash in Florida, you should immediately report it to the police, even if no injuries are apparent, as a police report can assist the insurance companies in determining who was at fault. And if you’ve suffered injuries in the accident, you should seek immediate medical attention. But it is important to note that in many cases, injuries are not immediately apparent at the time of an accident, and the victim may not experience pain or discomfort resulting from the incident until long after the initial reports have been filed. Many people assume that if they did not report actual injuries when the accident took place, the right to file a claim has been lost. That is not the case. The experienced attorneys at the Fenstersheib Law Group, P.A. have successfully handled hundreds of South Florida vehicular accident cases over the past three decades. In the State of Florida, you generally have four years from the date of a crash to file a personal injury claim. If you or a loved one has been involved in such an…Read More
