Slip and fall accidents, believed to be the second-leading cause of injuries in the United States, impact the U.S. economy heavily, with millions of dollars spent in hospitalization and medical expenses, and time missed from the workplace. The laws covering slip and fall accidents are complex, requiring many issues to be analyzed before fault can be assigned and negligence (and liability) can be determined. While the majority of these accidents result from improper property design or poor property maintenance, other factors – such as ongoing construction or adverse weather conditions – may come into play. Under the law, property owners are required to take reasonable care in the maintenance of their premises, so that they can avoid the risk of exposing others to the harm of a slip and fall accident – but this isn’t always the case. For instance, if you were not advised with appropriate signs of possible hazards, the establishment where you suffered your slip and fall may be held liable for your injuries. However, it is not merely enough for the property owner to post warning signs; such signs must be…Read More

When someone has died not as a result of natural causes, but due to another person’s or entity’s gross negligence or misconduct, the individual’s passing is legally considered a “wrongful death.” Numerous and different circumstances may be involved to encompass such negligence or misconduct, including medical malpractice or bad drugs; automobile, motorcycle or boating accidents; workplace accidents; product malfunction; unsafe conditions; or even outright malice. While no amount of reparations can replace the death of a loved one, you should always demand justice, holding the responsible party or parties accountable for their actions, and obtaining proper compensation for the financial and emotional loss suffered by you and your family – including medical costs, loss of future earnings, and non-monetary damages such as loss of companionship and emotional anguish. Lately, it seems as though almost every road we travel in South Florida is undergoing some type of construction work. While improving our roadways is both good and necessary, and road maintenance and construction are vital components to the ongoing growth of our State, these activities can also lead to the creation of road hazards, which may result in accidents and injuries to drivers, passersby and the construction workers themselves. You should be aware that, in the majority of cases, independent contractors are hired by State authorities to perform the construction and maintenance work on our highways. While construction companies and contractors have an obligation to ensure public safety, they might not be totally familiar with all State safety laws regarding highway construction projects, such as the proper placement of the necessary road signs, unmarked road hazards, and scattered debris resulting from the construction process. Fortunately, these contractors are required to have liability insurance to protect the public in the event of an accident. If you have been involved in an accident related to highway construction work in South Florida, you may be entitled to monetary damages.…Read More

The answer is: Flying is an extremely safe proposition. While your odds of being involved in a fatal aviation accident are along the lines of 1 in 10 million, your odds of being involved in a road accident, by way of comparison, are only 1 in 100. And flying with the top airlines almost literally doubles your odds for a safe flight. However, aviation accidents do happen, with much more extreme results than road accidents. Aviation accidents are most commonly linked to three primary sources: Pilot error, aircraft mechanical errors, and inclement weather – including lightning strikes, heavy winds, hazardous storms, and fog. Other potential causes of aviation accidents exist, such as air traffic control mistakes, cabin or cargo hold fires, bird strikes, and even sabotage. If you or a loved one has been injured in an aviation accident, you might be entitled to legal compensation for your pain and suffering. The Professional Aviation Accident Attorneys at the Fenstersheib Law Group, P.A. have the necessary experience and expertise regarding all the relevant aviation laws in Florida, which is absolutely vital for the success of any…Read More
According to a study conducted by Medicare’s Inspector General, the rate of medical errors resulting in injuries and death in skilled nursing facilities was much higher than that reported for hospitals. Skilled nursing facilities, which include certified nursing homes, typically provide follow-up treatment for patients after they have been discharged from acute care at a hospital, but medical errors at these establishments are not as widely reported as those that take place at hospitals. Errors that occurred during patient treatment at these facilities – including everything from dispensation of the wrong medications to infections – resulted in damages both temporary and permanent, and more than half of the patients who were harmed had to be hospitalized at additional expense. The study also revealed that a majority of these errors were actually preventable. If you or a loved one has been victimized by nursing home errors, please be aware that you have legal recourses available. At the Fenstersheib Law Group, P.A., we are your advocates; we feel your pain and, along with our legal expertise, offer understanding and compassion. We have been helping victims in South…Read More
Thousands of school children across South Florida head back to school in mid-August. As students get back to their daily travel routines, it’s important for all parents to take a little extra time to ensure their children’s safety. This becomes a peak time for accidents and injuries while walking, biking or riding to school. Most drivers have been used to a lack of children on the streets during the summer and may fail to realize that now there will be many more children on the road, due to the start of a new school year. 1. If your children walk to school, make sure they understand that they must walk on the sidewalk, and must walk facing traffic. If they cross streets on their way to and from school, instruct them to carefully look for cars coming in either direction. Also, impress upon them that they must walk especially carefully around parked cars. 2. If your children ride bicycles to school, make sure that they wear helmets. Review all the basic bicycling safety rules with your children, including hand signals, riding at safe speeds, riding…Read More
Study conducted by researchers at the University of Alberta, Canada, found that motorists who talk on cell phones while driving made more driving errors compared to drivers who were not engaged in phone conversations. The study revealed that these motorists were found to be much more likely to make common driving errors, including improper lane changes, driving at excessive speeds and suddenly crossing center lines. The researchers found that, even if a person is using a hands-free cell phone, there’s still an increase in brain activity and an increase in heart rate. Even if the conversation was not emotional in nature, the study revealed that there were definitely changes in the person’s emotional reaction to the conversation, resulting in an increase in the number of driving errors made – almost all of the participants in the test groups made some sort of driving error as a result of phone usage. If you have been involved in an automobile accident as a result of someone else’s negligence, you may be entitled to money damages. The Auto Accident Attorneys at the Fenstersheib Law Group, P.A. have over…Read More
Reflections On The 4th Of July As we celebrate the 242nd Anniversary of our Declaration of Independence, I am reflecting on how proud I am to be both an American and a Lawyer. While we all laugh at the many jokes constantly directed at the legal profession (and some of them are funny), it is important on every 4th of July to remember that many of our country’s forefathers were lawyers. Indeed, of the initial ten Amendments to the United States Constitution, four (Amendments 5-8) deal directly with legal rights. Four of the five members of our first Continental Congress entrusted with developing the Declaration of Independence were lawyers – Roger Sherman, John Adams, Robert Livingston and Thomas Jefferson. Two of them, Adams and Jefferson, went on to become Presidents of our county. And James Madison, the “Father of the Constitution” and the “Bill or Rights” (and our fourth president as well) was also a lawyer. In fact, 25 of the nation’s 45 Presidents have been lawyers. So I am indeed honored to practice this great profession, and to have the ability to fight for…Read More
